LDPOA: Do not institute a Fine Schedule without a vote of the members 

We have gone 45 yrs without a fine schedule and have seen numerous instances of abuses of power by Directors and violation committees. We believe that the decision should be up to the entire membership not just 7 directors who may have their own agendas

  1. I believe that this should be noticed in the Foothill Express, discussed thoroughly at a special meeting and that the members be allowed to vote on it. After all the association belongs to all the members.

    As a past director of the Assn when we wanted to vote on a resolution, first we did the following:
    We put the notice in the Discover and foothill express stating what we were proposing, the date of a special meeting (at least 30 days after notice) so that members could voice their opinions and we waited over 30 days before the board voted on it.

    We did this so that members were informed and had an opportunity to have their voices heard.

    When I asked a current director why they didn’t do the same, their answer was because we don’t have to.

    When I also asked why don’t they put this on the ballot and let the members vote.I was told because they don’t have to. Have they forgotten who they represent?

    My only reason for posting information on my blog and starting an online petition is to inform the members and let them decide whether they want this or not.

  2. Vicky! looks like a losing battle, 6 or 8 people posting on DP listings, 3 of which are board members, and no posts here!

  4. Like I said it is up to the members to decide. If they wait until the board votes this in then their ONLY RECOURSE will be getting a petition signed by 5% of the members (about 200)and presenting it to the board within 30 days of the Penalty Schedule resolution’s effective date.

    I have alerted them to the problems with this and provided them info and a forum and that is all I can do. It is now up to the members.

  5. Vicki, why dont u run for the POA board? Is it becuz the problems you had with the wtr board and the criminal charges you have? according to the pub records you are still on probation for some sort of misconduct and lies. Is that why you wont run?

  6. I have already been on the POA board.

    I have no criminal charges against me. What happened at the water board is an old but sad story in this community. It tells you how far some in this community will go to force someone off the board when they ask pesky questions like where is the money going.

    Also right after I was elected even before I attended my first wtr brd meeting 2 directors were going around telling people that they were going to get me off the board. These 2 directors were recalled off the LDPOA board by a majority of the members, yet felt it was my fault even though I wasn't even on the recall committee. Go figure.

    I did not have the funds (12-25,000) to fight it, even though the charges were all hearsay and I had several witnesses to refute them.

    My family decided to accept a misdemeanor plea and 2 yrs summary probation. All this because I wanted to serve this community.

    Those that know me know I did nothing wrong. Maybe now you can see why I feel that this Penalty Schedule will be at some point abused and used to settle old scores.

    Anyone that wishes to know more about what happened at the water board feel free to call me as I am the only Keefe in the book.

  7. PS Seems that some do not want me speaking out on having the members vote on the penalty schedule.

    Why is it that some do not want the members to have part in the decision making of THEIR Association?

  8. Public records say otherwise. why r u saying you have no criminal record? Becuz you do and it is public record. U r also on probation. why r u saying your family decided to accept a misdemeanor? It is you that was charged and on probation. It was not your family

  9. I can see that you are looking for a fight and I must tell you that this isn't the place for it. It is apparent that you have your own agenda and want to pick a fight with me Your comments have nothing to do with the Penalty Schedule or in helping the members that is why you are hiding behind a anonymous ID.

    If you want to discuss the Penalty schedule fine, it not I will delete any further comments from you.

    Your attempt to disguise yourself is pretty fun. I guess you know nothing about blogspot.

  10. Vickey and the water board is old news! The real deal is the fine schedule and I,m sure anonymous is with the board on that issue. And the statement by Julie that they won,t forclose on the fine is wrong. If you do get violated, don,t take care of it and it goes to fine, and you don,t pay the fine. It will fall under judicial forclosure just like not paying your dues. The members need to wake up and smell the coffee on this deal! There needs to be a pro and con section printed in the discoverer on this fine deal before the board votes on it, seems like its pretty one way at this point. I,m not surprised, thats how this association has been the 30yrs Ive been here, one bad board after another! Here is my take on why! the only satisfaction you get for serving on the board is (POWER) end of story! Mike Henault

  11. Well said Mike, I am not fighting this because I have violations, as I don't have any, but because I feel that it will be abused and members will suffer.

    If this is such a good deal then why not have a Special meeting just for this and then let the member decide what they want.

  13. This is in responce to the letter that was printed in the Discoverer on the fine schedule. The Board is wondering what the hysteria is all about. Here is my opinion on it, Its bad enough you give a group people the authority to tell a property owner there opinion on how and what there property should look like, and now you want to give them the power to forclose on that property if you don,t submit to there wishes.If you are fined and do not respond, it will go to judicial forclosure, just like not paying your dues! This sort of thing was tried by past boards (2004 revision committee) and was shot down by the members.(Bozsik,s pizza gathering) There are people involved with this fine schedule that were part of the last one that got shot down. Why must these same people keep repeating history when they already know LDPOA members do not want more LDPOA in there lives! I,ll tell you why! power plane and simple! This fine schedule has not been needed for the past 45yrs, why now? This proposed fine deal will hurt property values, if a property owner can not do what he or she dreams with there property it becomes worthless to them. It also looks worthless to someone that might want to buy in the subdivision, they see all these rules and a fine schedule, why would they want that, especialy in this housing market. I have been a member in good standing for near 30 yrs and all as I ever got from LDPOA was stress, and here I go again. This fine schedule needs to be put on the ballot and let the members decide. To all members out there, get a pettition going in your area to force this on the ballot. It only takes 5% of the total membership, less than 200 signatures. 10 members collecting 20 signatures each would do the trick. If you are interested in getting this started give me a call 852 2476. Remember its the majority of the property owners wishes that count, not just the board. This board needs to be reminded that!   14. Isn't it interesting that the majority of the board was appointed not elected by the members. Is this why they don’t seem to feel they have any obligation to the members?

    One of the appointed directors set up a blog where she stated that the town hall meeting was for the Penalty schedule, when in reality it was what we have been doing for years...having County officials come and talk to us.

    Why not tell the truth? Can we trust them to tell us the truth?
